Salary packaging for police
novated leases, electric cars and what each force allows

Salary packaging can save a police officer thousands a year, or cost them through fees, a balloon payment and a reportable benefit they didn't expect. Here's what each force allows, how the electric car exemption works and is changing, and worked numbers at real police salaries.

The short answer

Yes. Every Australian police force lets officers salary package, but what's on offer is set by each government's policy. Super and novated car leases are available almost everywhere. Police don't get the fringe benefits tax caps that let nurses and paramedics package rent or mortgages. An eligible electric car can be fully exempt from FBT, with changes announced from 1 April 2027.

What is salary packaging, and what isn't it?

You give up some pre-tax salary, and your employer provides a benefit of similar value instead.

The ATO calls it salary sacrifice, salary packaging or total remuneration packaging. You agree with your employer to take less salary before tax, and the employer pays for something on your behalf. Because your taxable income falls, you pay less income tax. Whether you come out ahead depends on how the benefit itself is taxed.

If the benefit attracts fringe benefits tax, someone pays 47% of its grossed-up value. Police packaging is cost-neutral to the employer, so that someone is you. That's why the useful items are those that are exempt or taxed lightly: super, an eligible electric car, and a short list of exempt work-related items.

The ATO's three conditions

For a salary sacrifice arrangement to work, you must agree it before you do the work, have an agreement with your employer, and have no access to the sacrificed salary. You can't sacrifice salary, leave or bonuses you've already earned. Expenses simply deducted from your net pay aren't salary sacrificed.

What does each police force allow?

Every police instrument we read allows packaging, but none lists the full menu. Most refer to the employer's or the state government's policy, which can change without the agreement changing. Here's what the clauses say, and what the government policy shows where we could read it.

Salary packaging in each police instrument

NSW

Clause
Award cl 8
What it says
Package up to 100% of the loaded salary (NCOs) or salary (commissioned officers), for benefits the Commissioner approves. Allowances, penalties and leave payouts are worked out on pre-package salary. You must elect before the period of service.
Novated car lease
Not named in the award; depends on the Commissioner's approved list

Victoria

Clause
EA cl 78
What it says
Package remote area benefits, super, a motor vehicle lease, Qantas Club membership or anything else permitted by tax law. You meet the full cost of any FBT. No admin charge for packaging super. Either side can end it on 4 weeks' notice.
Novated car lease
Yes, named in the clause

Queensland

Clause
CA cl 14
What it says
Packaging under Queensland Government policy. The government's administrator fact sheet lists 15 FBT-exempt items, including super and portable electronic devices.
Novated car lease
Yes, through the government's novated leasing arrangement (from 1 March 2024)

WA

Clause
Agreement cl 10.12
What it says
Packaging under the employer's flexible remuneration arrangements. Must be cost neutral; you bear any extra tax. Overtime and leave loading use pre-package salary. Agreement can't be unreasonably withheld.
Novated car lease
Motor vehicles named as a non-cash benefit in the TEC definition

SA

Clause
SAPOL benefits page
What it says
Salary sacrifice to super (including Triple S) and novated leasing through the SA public sector arrangement.
Novated car lease
Yes, per SAPOL

Tasmania

Clause
Award cl 24
What it says
Salary sacrifice to a complying super fund. Other items depend on state service policy.
Novated car lease
Not confirmed on a primary source

NT

Clause
CA 2022 cl I3
What it says
NT Public Sector salary sacrifice arrangements apply on the same terms, conditions and fees. Super and severance use gross salary before sacrifice.
Novated car lease
Available under NT public sector arrangements (reported by providers; not confirmed on a government page)

AFP

Clause
EA s16, s17(7)
What it says
Entitled to participate in the AFP's flexible remuneration packaging. Employer super isn't reduced by salary sacrifice.
Novated car lease
Not named in the EA; ask AFP payroll

Read from each instrument in October 2026. 'Not confirmed' means we couldn't find it on an official page, not that it's unavailable. Your payroll or packaging administrator has the current list.

The clauses protect you in one useful way. In NSW, WA and the NT, overtime, allowances, leave payouts or super are worked out on your salary before packaging, so packaging doesn't cut them. Victoria's EA says the same for super and every other purpose. For your own pay, see the take-home pay calculator.

Why can't police package rent or a mortgage, like nurses and paramedics?

This is the most common misunderstanding. Nurses, paramedics and charity staff can package everyday expenses because their employers have a special FBT exemption or rebate, capped per employee. Police forces aren't on that list, so there's no tax-free amount for living expenses.

From the ATO's FBT rates and thresholds page. Meal entertainment and venue hire are capped separately at $5,000 for the concessional employers.

If a police employer paid your mortgage, it would be an expense payment fringe benefit taxed at 47% on the grossed-up value. Because packaging is cost-neutral, that FBT would come out of your package. For someone on a 32% marginal rate, that's a large loss, so forces simply don't offer it.

How does a novated lease actually work?

A novated lease is a three-way agreement. You lease a car from a finance company, then your employer takes over (novates) the lease obligations while you work for them. Your employer pays the lease and running costs from your salary, part before tax and part after, and claims GST credits it passes on to you.

  1. 1

Choose a car and get a quote

    Quote

The packaging provider quotes finance, a running-cost budget (fuel or electricity, servicing, tyres, registration, insurance) and a residual payment.

  2. 2

Sign the lease and the novation agreement

    Agreement

The finance company, you and your employer sign. Your employer takes on the payments while you're employed.

  3. 3

    Payroll deducts each pay

    Each pay

Pre-tax deductions reduce your taxable salary. Any post-tax employee contribution reduces the car's FBT, often to nil.

  4. 4

Running costs are paid from the budget

    Ongoing

The provider pays bills or reimburses you, and reconciles the budget at least yearly. Unspent budget may be returned to you as taxable salary.

  5. 5

At the end, pay the residual

    End of term

You pay the balloon, refinance it into a new lease, or sell or trade the car to cover it.

For a petrol or hybrid car, FBT is usually worked out with the statutory formula: 20% of the car's base value, whatever distance you drive. Making a post-tax employee contribution equal to that taxable value reduces the FBT to nil. This is called the employee contribution method, and the ATO's own example uses it.

How does the electric car FBT exemption work today?

An eligible electric car, and its running costs, can be packaged entirely before tax with no FBT.

Since 1 July 2022, employers haven't paid FBT on private use of an eligible electric car, including through salary packaging. Registration, insurance, repairs, maintenance and the electricity to charge it are exempt too. That means the whole lease and running budget can come out of pre-tax salary, with no post-tax contribution.

The car qualifies only if

  • ✓ It's a battery electric or hydrogen fuel cell electric car, designed to carry under one tonne and fewer than 9 passengers
  • ✓ It was first both held and used on or after 1 July 2022
  • ✓ Luxury car tax has never been payable on it: for 2026-27, a value under $91,661 at first retail sale, and in every sale since
  • ✓ It's used by a current employee or their family
  • ✓ For a plug-in hybrid: only if it was exempt before 1 April 2025 and there's a binding commitment to keep providing it

Home charging can be costed at a flat 5.47 cents a kilometre for the FBT year from 1 April 2026 (it was 4.20 cents before), under the ATO's PCG 2024/2. A home charging station isn't a car expense, so it isn't covered by the car exemption. Electric motorcycles and scooters aren't cars and don't qualify.

Exempt from FBT is not the same as invisible

The ATO is explicit: an exempt electric car is still a reportable fringe benefit. Its grossed-up value appears on your income statement and is counted for HELP repayments, the Medicare levy surcharge, Division 293 and several government payments. See the reportable benefit catch below.

What's changing for electric cars from 1 April 2027?

On 5 May 2026 the Government announced it would replace the full exemption with a permanent 25% FBT discount, phased in. Treasury released draft legislation for consultation from 10 to 28 September 2026. As at 9 October 2026 it isn't law, so details could still change.

Announced phase-down of the electric car FBT exemption

Before 1 April 2027

Car valued at $75,000 or less
Full exemption
Car over $75,000 (and under the luxury car tax limit)
Full exemption

1 April 2027 to 31 March 2029

Car valued at $75,000 or less
Full exemption
Car over $75,000 (and under the luxury car tax limit)

From 1 April 2029

Car valued at $75,000 or less
25% discount
Car over $75,000 (and under the luxury car tax limit)
25% discount

From the Budget 2026-27 tax reform page and Treasury's consultation page. Not yet legislated. Commentary on the draft says the 25% discount works by applying a 15% statutory rate instead of 20%, and that existing arrangements keep the treatment that applied when they began; confirm against the final law.

For a police officer, the practical message is timing. A car up to $75,000 keeps the full exemption if the arrangement starts before 1 April 2029, under the announced rules. A car above $75,000 needs to be committed before 1 April 2027 for full exemption. The ATO separately says the Government will review the exemption by mid-2027.

Don't sign a lease because a deadline is coming. Sign it because the car and the numbers suit you.

Worked example: a petrol car with the employee contribution method

Petrol and most hybrid cars aren't exempt, so FBT applies unless you cover it with an after-tax contribution. Take a hypothetical $40,000 car with $14,000 a year of lease and running costs, for the same NSW Senior Constable on $139,688.

Calculated by us, ignoring GST. In practice the employer claims GST credits on the purchase price (up to the car limit) and running costs and passes them on, which is often the larger saving for a petrol car. The ATO's own worked example shows the effect with GST included.

The tax saving here is about $2,248 a year, against roughly $5,128 for the electric car. That gap is why the electric car exemption gets so much attention. GST savings and fleet discounts can narrow it, so compare quotes on the total cost over the lease.

The reportable fringe benefit catch

When an employee's fringe benefits have a taxable value over $2,000 in an FBT year, the employer must report the grossed-up value on the income statement. Reportable benefits use the lower gross-up rate of 1.8868. For an exempt electric car, the employer works out a notional taxable value as if FBT applied.

Hypothetical EV base value

$55,000

for illustration

Notional taxable value

$11,000

20% statutory formula

Reportable amount

$20,755

× 1.8868

That reported amount doesn't change your income tax. It is added back for several tests. For the NSW Senior Constable with a HELP debt, compulsory repayments rise from $10,723 to $11,702: about $978 more, calculated by us. Their net gain falls from $5,128 to about $4,150.

Reportable fringe benefits are counted for

  • ✓ HELP and other study loan repayment income
  • ✓ The Medicare levy surcharge income test, if you don't have hospital cover
  • ✓ Division 293 income, for officers near $250,000
  • ✓ Child support assessments
  • ✓ Parental Leave Pay, Family Tax Benefit and Child Care Subsidy income tests

Senior officers should read Division 293 for police before leasing an expensive electric car, because the reportable amount adds directly to Division 293 income. If you have a HELP debt, run both scenarios before signing.

What are the risks: leaving, leave and the residual?

Where a novated lease can work well

  • ✓You'd buy a car anyway and keep it for the lease term
  • ✓It's an eligible electric car and you're on a 32% marginal rate or higher
  • ✓You plan to stay with your force for the whole lease
  • ✓You've compared the interest rate and fees with a car loan

Where it can go wrong

  • ✕You resign, transfer interstate or move to another force mid-lease
  • ✕You take long unpaid leave, such as extended parental leave
  • ✕The residual is larger than the car's value at the end
  • ✕Fees, insurance and the running budget are priced above what you'd pay yourself

If you leave, your employer's side of the deal ends. The lease usually reverts to you, so you keep paying from after-tax income, or you transfer it to a new employer that agrees. A transfer from, say, a state force to the AFP isn't automatic. Read our guide to resigning from the police before you sign a long lease.

Typical minimum residual values on car leases

4 years

5 years

Minimum residual (% of the car's cost)
28.13%

Published by lease providers as the ATO-based minimum residuals; we couldn't read the underlying ATO determination directly. Your quote will show the exact residual.

The residual (balloon) is due at the end of the lease. On a 5-year lease of a $55,000 car, a 28.13% residual is about $15,472. Don't assume the car will be worth more than the residual when the lease ends; check current used prices for the model. If you're buying a home soon, lenders count the lease repayments; see police home loans.

What else can police package?

Beyond super and cars, the list is short and employer-specific. Queensland is the only force where we could read the government's full item list. The government approves 15 FBT-exempt items for its employees, including super, professional association membership, income protection insurance, financial adviser fees and portable electronic devices.

Queensland police: body-worn cameras and binoculars

The Queensland Government fact sheet says that, for QPS only, privately bought body-worn cameras and night vision and range-finding binoculars can be packaged as portable electronic devices under an ATO ruling. Body-worn cameras need written approval on form QP 0984; binoculars need a declaration. Use must be more than 50% for work.

That may not last. The ATO says that from 1 April 2027, portable electronic devices, computer software, protective clothing, briefcases and tools of trade will no longer be FBT-exempt when provided through salary sacrifice. They'll stay exempt when the employer provides them outside a salary sacrifice arrangement. If you're planning a work device purchase through packaging, check the timing.

Super remains the most widely available item everywhere. Our salary sacrifice guide shows how much cap room you have at each rank after your employer's 12% to 18% contribution. For deductions you claim yourself, see police tax deductions and car and travel deductions.

Before you sign: a checklist

  • ✓ Ask payroll for your force's current list of packageable items and approved providers
  • ✓ Get at least two novated lease quotes and compare the total cost over the term, including interest, fees and the residual
  • ✓ Check whether the car meets the electric car exemption, and its value against $75,000 and $91,661
  • ✓ Work out the reportable fringe benefit and its effect on HELP, the Medicare levy surcharge and family payments
  • ✓ Read the exit terms: resignation, transfer, unpaid leave, write-off and early payout
  • ✓ Check the insurance in the running budget against a quote you'd get yourself
  • ✓ Confirm with payroll that overtime and allowances are still paid on your pre-package salary

This is general information, not financial, tax or credit advice, and we don't recommend any provider or product. Your police association, a registered tax agent or a licensed financial adviser can look at your own situation. To check the budget side, our budgeting on shift work guide shows how to plan around a guaranteed fortnightly figure.

Frequently asked questions

Can police officers salary package?

Yes. The NSW award (cl 8), Victorian EA (cl 78), Queensland agreement (cl 14), WA agreement (cl 10.12), Tasmanian award (cl 24), NT agreement (cl I3) and AFP agreement (s16) all provide for it, and SAPOL says salary sacrifice and novated leasing are available. The items you can package are set by your employer's policy, not by the tax law alone.

Can police salary package their mortgage or rent like nurses?

No. The capped FBT exemptions that let staff of public hospitals, public ambulance services and public benevolent institutions package everyday expenses don't apply to police forces. If a police employer paid your mortgage through a package, fringe benefits tax at 47% would apply, and under cost-neutral arrangements you'd bear it. That usually wipes out the benefit.

Is an electric car on a novated lease exempt from FBT?

It can be, if it's a battery electric or hydrogen fuel cell car, it was first held and used on or after 1 July 2022, and luxury car tax has never been payable on it. For 2026-27 that means its value at first retail sale was under $91,661. Plug-in hybrids stopped qualifying from 1 April 2025, except under commitments made before then.

Is the EV FBT exemption ending?

Changes were announced on 5 May 2026. Under the published plan, cars over $75,000 move to a 25% FBT discount from 1 April 2027, and all eligible electric cars from 1 April 2029. Cars up to $75,000 keep the full exemption if the arrangement starts before 1 April 2029. Draft legislation was released for consultation in September 2026.

Does a novated EV affect my HELP repayments?

Usually, yes. The exempt car is still a reportable fringe benefit, and its grossed-up value is added to your HELP repayment income. In our NSW Senior Constable example, packaging $15,000 of costs saves tax, but the reported $20,755 lifts compulsory HELP repayments by about $978 a year.

What happens to my novated lease if I leave the police?

The employer's part of the agreement ends when you stop being their employee. Usually the lease then reverts to you, so you make the payments from after-tax income, or you transfer it to a new employer who agrees to take it on. Read the novation agreement for exit fees and what happens if you move between forces.

Can I claim car expenses for a novated lease car?

No. The ATO says you don't own, lease or hire a car held under a salary sacrifice or novated lease, so you can't claim car expenses using either method. You can still claim parking and tolls on work trips. That matters if you use your own car for work, for example travelling between stations.

Is salary packaging worth it for a police officer?

It depends on the item. Super and an eligible electric car can be worthwhile because they're taxed lightly or not at all. A petrol car saves less, mainly through GST and the employee contribution method. Weigh fees, interest rates, residual payments and the effect of reportable benefits on HELP, the Medicare levy surcharge and family payments.
